The Labor Department is seeking approval for a revised information collection covering certificates for housing used by migrant agricultural workers. Its October 30 notice invites comments through November 30, 2026, while describing existing inspection and certificate requirements.
An optional form, a required certificate
The notice says the Migrant and Seasonal Agricultural Worker Protection Act requires a person who owns or controls housing used for migrant agricultural workers to post a copy of its certificate of occupancy at the site.
That certificate attests that a state, local or federal agency inspected the housing for safety and health and verified that it meets applicable standards. The notice says migrant agricultural workers may not be housed at a facility or property without the certificate.
The original must be retained for three years and made available for inspection when the department requests it. Labor makes Form WH-520 available as an optional way to meet these purposes. The form's optional status does not make the certificate optional.
What the paperwork request covers
Labor seeks authorization under the Paperwork Reduction Act for three years. It describes the request as a revision of the information collection and says existing collections submitted for review receive month-to-month extensions during that review.
The notice estimates ten respondents, ten responses and one hour of annual time burden, with no annual other-cost burden. Those are estimates for this information collection, not a census of all agricultural-worker housing or a finding that housing conditions comply with the law.
This is an information-collection review, not an announcement of a new housing standard or a report of inspections performed.
How to comment
Labor invites scrutiny of the collection's usefulness, the accuracy of its burden and cost estimates, and ways to improve information quality or reduce reporting burden.
The notice directs written comments and recommendations to RegInfo.gov's public information-collection review page. Locate the collection under the open 30-day reviews or use the search function. Comments should reference OMB Control Number 1235-0006 so the agency can identify the collection.
